So on December 6, 2012 the important decision of the Supreme Court of the Russian Federation of No. AKPI12-1427 according to which for extension of permission to the cut and smooth-bore hunting weapon departments of license and allowing work cannot demand from citizens of providing the document on training passing for check and improvement of skills of safe handling of the weapon took place.
From the date of coming into effect of a judgment point 9.3 of Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on providing the state service in delivery to the citizen of the Russian Federation permissions to storage and carrying of the hunting fire dlinnostvolny weapon, the sports fire dlinnostvolny smooth-bore weapon, the hunting pneumatic weapon or firearms of limited defeat and cartridges to it, the Ministry of Internal Affairs of the Russian Federation approved by the order from April 27, 2012 of N 373, in a part assigning to the applicant addressed with the statement for extension of period of validity of permission to storage and carrying of firearms of limited defeat, a duty to present the document on passing of preparation by it with a view of studying of rules of safe handling of the weapon and acquisition of skills of safe handling of the weapon is changed.
Since July 15, 2015 the new law on which receiving service of physical examination occurs in a new way took effect. Earlier the competitor could address in any medical institution having the license for the relevant medical board, and in a mode of «one visit» for the established payment to pass all specialists doctors. Thus to doctors of such specializations as the expert in narcology and the psychiatrist, under the contract involved in medical commissions for survey on the right of management of vehicles, the rights of possession of the weapon, works at height, etc., on the basis of private practice was authorized to examine wishing about compliance of a condition of their health the defined legislator to requirements. It citizens as it was very convenient both on time, and on means actively used.
Since July 15 this order is toughened. Now references of the expert in narcology and the psychiatrist on absence of contra-indications, for example, on possession of the weapon, citizens receive in a place of registration. Thus, for registration of the medical certificate it is necessary to visit the relevant licensed medical commission, to get there the reference form, to fill it, and for this purpose to receive the decision of the therapist and the oculist. Then with the reference on hands to proceed on survey of the psychiatrist and the expert in narcology (the sequence of value has no) in a residence – in the corresponding narcological or psychoneurological clinic. Where such clinics as are not present separate establishments, doctors are in regional (regional) hospitals. Having received for an additional payment the decision of the expert in narcology and the psychiatrist, the competitor again provides them to the medical board which has issued the form of not certified reference then the reference is certified by the press of the organization (medical board) and is entered in the register. Due to the new order more trouble and total amount of expenses was added increased, for the rest the order remained the same. The extract of references other, including an old method, since July 15, 2015 is considered illegal. The same way now receive also other references – medical certificates in which survey of the expert in narcology and the psychiatrist is necessary.
It is necessary to notice that survey operates 1 day. That is, if, for example, you want to receive at the expert in narcology or the psychiatrist the certificate of absence of contra-indications for the commission on the weapon, for the driver’s commission, for the "high-rise" commission, it is necessary to show to the specified medical experts all three forms of the references which have been in advance written out in medical boards (then you can receive the conclusions for one price for three places). If you plan to pass completely today «driver’s medical board», and in three days the commission «on the weapon», the expert in narcology and the psychiatrist should be passed twice, with the corresponding double payment. This remark I consider especially important that cost of services of these experts for one survey makes more than 600 rubles in the region of St. Petersburg.
Today, to receive treasured medical decision (for different cases) for smaller cost, is necessary to specify previously information on cost of services of different medical boards. Thus, it is possible to save to 50 % of cost of the reference and passing of the therapist and the oculist. On cost of services of the expert in narcology and the psychiatrist, unfortunately, to save it will not turn out, as there is no alternative of passing in other place. Data on the weapon resolved to a turn in the Russian Federation, contain in the State inventory of the civil and office weapon and cartridges to it. The relations arising at a turn of the weapon (its manufacturing, purchase and sale, storage and use), are regulated by the Federal law «About the weapon». Classification of the civil weapon is given in Law Art. 3. Except for the sports and hunting weapon, the main types of the resolved civil weapon are:
• The self-defense weapon (the fire smooth-bore dlinnostvolny weapon with cartridges, including traumatic action; firearms of limited defeat (the gun, a revolver, the fire besstvolny device of a domestic production) with cartridges of traumatic action, cartridges of gas action and cartridges of svetozvukovy action.
• The antiquarian weapon (not intended for firing by cartridges and made till the end of 1899, cold – till 1945).
• Alarm weapon.
The civil firearms should exclude firing by turns and have capacity of shop (drum) no more than 10 cartridges.
Action of departments of license and allowing work in Ministry of Internal Affairs system of Russia on delivery of permissions to storages and carrying of a different type of weapon are regulated including orders of the Ministry of Internal Affairs of the Russian Federation from 4/26/2012 by No. 366 (the license for acquisition of the cut weapon), from 4/23/2012 No. 355 (the license for acquisition of the smooth-bore hunting weapon), from 4/27/2012 No. 373 (delivery of permission to storage and carrying of the smooth-bore and cut hunting weapon).
As before, for extension of period of validity of permission the applicant represents:
1. Passport of the citizen of the Russian Federation.
2. Statement.
3. Copy of the permission which is subject to extension.
4. Medical certificate about absence of contra-indications to possession of the weapon, connected with sight violation, a mental disease, alcoholism or drug addiction.
5. The document on passing of check of knowledge of rules of safe handling of the weapon and existence of skills of safe handling of the weapon (it is represented at extension of permission to storage and carrying of firearms of limited defeat).
6. A copy of the hunting ticket of a uniform federal sample (it is represented the applicant to whom in the order established by the law the right to hunting is provided).
7. The order of the head of the organization or a hunting economy (carrying out kinds of activity according to authorized tasks in the hunting sphere), the applicant confirming the right to occupation by the professional activity connected with hunting (it is represented the applicant who is engaged in professional activity, connected with hunting).
8. Two photos in the size 3×4 see.
Copies of documents are represented together with originals and are certified by the signature of the employee of department of license and allowing work. In case the specified documents or their copies were represented by the applicant in division of license and allowing work, documents are valid and the data reflected in them did not undergo changes, repeated submission of such documents or their copies is not required.
For example, period of validity of medical certificate about absence of contra-indications to possession of the weapon, connected with sight violation, a mental disease, alcoholism or drug addiction, makes 1 year. If at you in different terms the smooth-bore hunting weapon and the cut hunting weapon is registered, during period of validity of this medical certificate she will be suitable for both in case of a re-registration and obtaining new licenses for acquisition of other weapon (under the law – until 5 units on one citizen).
